Policy

Delivery Policy (Digital Services)

Everything sold on tax-samadhan.com is a professional service delivered digitally. Nothing is shipped, there is no delivery address, and no shipping charge is ever added. This policy explains how work reaches you, at what moment delivery is complete, and how that differs between a one-off report and a continuing retainer.

1. Scope

1.1 This policy applies to services supplied by TAXSAMADHAN CONSULTING PRIVATE LIMITED, CIN U74120UP2022PTC167960, registered office 19/201, Sundram Khand, Sector 19, Vasundhara, Ghaziabad, Uttar Pradesh 201012, India. It forms part of the Terms & Conditions.

1.2 We supply no physical goods. There is no courier, no tracking number, no shipping estimate and no delivery charge. If a checkout field asks for an address, it is a billing address used for invoicing and to determine the GST treatment described in clause 5 of the Terms & Conditions.

2. What you receive

2.1 Deliverables are the artefacts named in the Engagement Confirmation and on the relevant service page. Depending on the engagement they take these forms:

  • Reports, opinions and memoranda, issued as PDF.
  • Computations, schedules, reconciliations and financial models, issued as spreadsheet files, with a PDF summary where the engagement calls for one.
  • Filed forms and returns, issued as the filed copy together with the acknowledgement generated by the relevant portal.
  • Registers, ledgers and month-end packs, issued in the agreed format on the agreed cycle.
  • Presentation material and board papers, issued as PDF, and in editable format where the Engagement Confirmation says so.
  • Recorded advice, issued as a written note. Nothing significant is left as an oral view alone.

2.2 Where a Deliverable requires a registered signatory, work requiring a registered signatory is performed and signed by a professional holding the relevant registration, and the signed copy is what you receive.

3. How work is transmitted

3.1 Email. The ordinary channel. Deliverables are attached, or linked from a secure store, and sent to the email addresses you nominate in writing.

3.2 Secure file transfer. Where the material is large or particularly sensitive, we send a time-limited link to a controlled folder rather than an attachment. Links expire and access is logged.

3.3 Your own systems. Where a retainer runs inside your accounting platform, document management system or shared drive, delivery happens in that system, and the Engagement Confirmation records which system and which folder.

3.4 Statutory portals. Where the deliverable is a filing, the filing itself is made on the relevant government portal from the correct credentials, and the acknowledgement is sent to you.

3.5 We do not deliver through consumer messaging apps or social media. WhatsApp is used for coordination only, never as a channel for client records or Deliverables.

4. When delivery is complete

4.1 A report, opinion or other one-off deliverable

4.1.1 Delivery is complete when the final Deliverable has been sent to the nominated email address, or made available at a secure link and the link notified to you. Delivery is not conditional on you opening the file, and it is not deferred because you have not yet read it.

4.1.2 A draft shared for comment is not delivery of the final Deliverable, but sharing a draft is a milestone with consequences under clause 3.4 of the Refund & Cancellation Policy.

4.2 A filing or submission

4.2.1 Delivery is complete when the filing has been submitted on the relevant portal and the acknowledgement has been sent to you. Where a portal is unavailable on a statutory due date, we tell you the same day and record the attempt.

4.3 A retainer or continuing service

4.3.1 Delivery is continuous, not a single event. For each billing period, delivery is complete when the services agreed for that period have been performed and the agreed outputs for that period issued — the month-end pack, the reconciliations, the returns, the review call.

4.3.2 Availability during business hours is itself part of what is delivered. Reserved capacity that you do not use has still been supplied, which is why unused hours are neither carried forward nor refunded under clause 6.3 of the Refund & Cancellation Policy.

4.4 A consultation

4.4.1 Delivery is complete when the scheduled call has been held. A call missed without at least 4 business hours’ notice is treated as held. Where we cancel, the call is rescheduled at no charge.

5. Timelines

5.1 The scoping call is normally held within one Business Day of order confirmation. The delivery timeline for the engagement is fixed in the Engagement Confirmation issued after that call, in business days or weeks, against the specific scope.

5.2 Indicative ranges shown on a service page are planning figures, not commitments. The Engagement Confirmation is the commitment.

5.3 Time runs from the later of the date of the Engagement Confirmation and the date we receive the complete information listed in it. Where information arrives late or in parts, the delivery date moves by at least the length of the delay, and we tell you the revised date rather than letting it drift.

5.4 Where a statutory due date governs, we work to an internal date ahead of it and tell you at once if that date is at risk.

5.5 Business days are Monday to Friday, excluding public holidays in Uttar Pradesh. Our hours are 09:30 to 18:30 IST.

6. Confirming receipt, and what to do if nothing arrives

6.1 Tell us if a Deliverable does not reach you by the agreed date. Check spam and quarantine filters first, since PDF and spreadsheet attachments from an unfamiliar sender are commonly held there.

6.2 On request we re-send by an alternative channel at no charge, and we confirm the date and time of the original transmission from our records.

6.3 It is your responsibility to keep the nominated email addresses current and monitored, and to tell us in writing when a recipient leaves your organisation.

7. Re-issue and archive

7.1 We keep engagement files and the Deliverables issued from them for 8 years from completion, as set out in the retention table in the Privacy Policy.

7.2 A copy of a Deliverable already paid for is re-issued on request within 3 Business Days at no charge, subject to identity verification.

7.3 Re-issue is a copy of the original document. Updating a Deliverable to reflect a later position, a changed fact or a change in law is new work, requires your written approval of the additional fee before it starts, and is not re-issue.

8. Clients outside India

8.1 Delivery to clients outside India is identical: the same channels, the same completion points, the same timelines. Nothing crosses a border physically and no customs, duty or import charge arises.

8.2 Scheduling accommodates time zones where we can, but our working hours remain 09:30 to 18:30 IST, Monday to Friday.

8.3 Where the supply is an export of services, it is invoiced without GST on the basis described in clause 5.3 of the Terms & Conditions.

9. If a Deliverable is late or does not conform

9.1 If we are late for a reason within our control, we tell you before the date passes, give a revised date, and where the delay is material you may cancel and be refunded the unearned portion under clause 3.3 of the Refund & Cancellation Policy.

9.2 If a Deliverable does not meet the agreed scope, it is re-performed at no charge or the affected portion refunded, under clause 5 of that policy.

9.3 Response and escalation standards during an engagement are in the Service Level Commitments. Complaints go through the Grievance Redressal Policy.
